A contract needs to be organized when you are hiring a domestic helper to ensure that your helper has the proper immigration status to remain in Hong Kong.

An application is made with the Labour Department at the Immigration Department. If you have had an agency assist you in finding your maid then they will assist with the contract. The length of the process can vary, sometimes up to 2-3 months and the employer is responsible for all associated costs. Normally the maid may have to return to the Philippines until the visa approval has come through.

Generally, apartments in Hong Kong have accommodation at the rear of the kitchen for a maid’s room and bathroom. As the employer you have to provide adequate living accommodation including a bed, bedding etc. Most apartments have adequate accommodation, although tiny, and can be made fairly comfortable by the provision of air-conditioning and access for a TV.

Sunday is the mandatory day off for all helpers (you will see them all congregate in Central). Public holidays are also given as days off. You must also provide one week annual leave for every year of service and cover the cost of a return airfarer to their home country.

Contracts are valid for two years. If your agency is not assisting with the submission of the contract then you can obtain forms from the immigration department.

If you are not happy with your maid then you can terminate the contract with one month’s notice. We recommend that if you decide to terminate a maids employment that you pay one month's salary in lieu of notice. You must also notify the immigration department.
